II. MANAGEMENT RIGHTS
The parties recognize that the law and constitution of the State of Rhode Island assign, among others, the following responsibilities, rights, authority, and duties to the Committee and its designees:
A. Management and administrative control of the schools within the district, and its properties and facilities;
B. Hiring, promoting, transferring, assigning, and retaining employees within the school district;
C. Suspending, demoting, discharging or taking other disciplinary action against employees, relieving employees from duty because of lack of work or other legitimate reasons;
D. Establishing the curriculum, including courses of instruction, providing for athletic, recreational and social events for the district's students, all as deemed necessary or advisable by the Committee;
E. Deciding the means and methods of instruction and the duties, responsibilities, and assignments of employees with respect thereto.
The Committee hereby retains and reserves unto itself, without limitation, all power, rights, authority, duties and responsibilities conferred upon and vested in it by the law and constitution of the State of Rhode Island. Moreover, the parties recognize that the Committee is legally without authority to surrender or otherwise abdicate its rights and responsibilities to any other person or organization, including the Union.
The parties recognize that the Superintendent and those administrators acting at the direction of the Superintendent are vested by law with certain powers, rights, authority, duties and responsibilities that may not legally be surrendered or otherwise contracted away. Whenever in this agreement there is reference to the Superintendent it is understood that the term includes those authorized administrative personnel acting at the direction of and/or on behalf of the Superintendent.
